Termini e Condizioni Generali di Vendita
1. Disposizioni generali
L’utente, navigando in quest’area, accede al sito web Misino System. La navigazione e la trasmissione di un ordine di acquisto sul sito Misino System comportano l’accettazione delle presenti Condizioni Generali di Vendita, nonché delle Politiche di Protezione dei Dati, contenute nell’apposita sezione “Privacy Policy” del sito web.
L’utente è tenuto, prima di accedere ai prodotti e servizi forniti dal sito, a leggere le presenti Condizioni Generali di Vendita, che si intendono generalmente ed inequivocabilmente accettate al momento dell’acquisto.
Misino System si riserva il diritto di modificare le presenti Condizioni Generali di Vendita in qualsiasi momento.
Si invita l’utente a scaricare e stampare una copia del modulo d’acquisto e delle presenti Condizioni Generali di Vendita.
2. Oggetto
Le presenti Condizioni Generali di Vendita si applicano esclusivamente all’acquisto di prodotti e alla fornitura di servizi commercializzati, tramite il sito web, ai propri Utenti, conformemente alle disposizioni della Parte III, Titolo III, Capo I, Codice del Consumo (D.lgs. n. 206/05) direttamente da:

Misino System non è pertanto responsabile per la vendita di prodotti e/o fornitura di servizi da parte di soggetti terzi, eventualmente presenti sul proprio sito, tramite link, banner o altri collegamenti ipertestuali.
Prima di inoltrare ordini ed acquistare prodotti e servizi da soggetti diversi, si suggerisce, quindi, di verificare le loro condizioni di vendita.
3. Conclusione del contratto
Per concludere il contratto, sarà necessario compilare il modulo di acquisto seguendo le istruzioni che compariranno sul sito.
Il venditore non è, in ogni caso, responsabile dell’eventuale inadeguatezza delle rappresentazioni grafiche dei prodotti, avendo le stesse funzione meramente illustrativa.
Prima di concludere il contratto, sarà richiesto all’utente di confermare l’avvenuta lettura delle Condizioni Generali di Vendita, comprensive dell’Informativa sul diritto di recesso e del trattamento dei dati personali, nonché di approvare specificamente, ai sensi degli artt. 1341 e 1342 c.c., alcune clausole contenute nelle presenti Condizioni Generali di Vendita.
Il contratto è concluso quando il venditore riceve il modulo d’acquisto, previa verifica della correttezza dei dati ivi contenuti.
L’acquirente sarà obbligato al pagamento del prezzo dal momento in cui la procedura di inoltro dell’ordine on line sarà conclusa. Ciò avverrà cliccando sul pulsante “completa il mio ordine” alla fine della procedura guidata.
Concluso il contratto, il venditore prende in carico l’ordine per la sua evasione e verrà trasmessa all’utente una e-mail di conferma dell’ordine.
4. Utenti registrati
La registrazione al sito e l’acquisto dei prodotti è consentito a tutti i soggetti che, se persone fisiche, abbiano compiuto gli anni 18.
Nel completare la procedura di registrazione, l’utente si obbliga a seguire le indicazioni presenti sul sito e a fornire i propri dati personali in maniera corretta e veritiera.
L’utente si impegna a comunicare tempestivamente a Misino System qualsiasi variazione dei propri dati, esonerando comunque Misino System da ogni responsabilità in caso di inesattezza dei dati forniti. Qualora l’utente comunichi dati non esatti o incompleti, ovvero anche nel caso in cui vi sia contestazione da parte dei soggetti interessati circa i pagamenti effettuati, Misino System avrà facoltà di non attivare ovvero di sospendere il servizio fino alla corretta comunicazione di tutti i dati richiesti.
In occasione della prima richiesta di attivazione di un profilo da parte dell’utente, Misino System attribuirà allo stesso un nome utente ed una password. Quest’ultimo riconosce che tali identificativi costituiscono il sistema di validazione degli accessi dell’utente ai Servizi ed il solo sistema idoneo ad identificare l’utente e che gli atti compiuti mediante tale accesso saranno a lui attribuiti e avranno efficacia vincolante nei suoi confronti.
L’utente si obbliga a mantenerne la segretezza dei suoi dati d’accesso e a custodirli con la dovuta cura e diligenza e a non cederli, anche temporaneamente, a terzi.
In ogni caso, l’utente registrato si impegna a tenere manlevata ed indenne Misino System da qualsiasi pretesa, danno, obbligo risarcitorio e/o sanzione derivante, o comunque collegata, alla violazione da parte dell’utente delle regole sulla registrazione al sito o sulla conservazione delle credenziali di registrazione.
5. Prodotti commercializzati, proprietà intellettuale e patto di riservatezza e di non divulgazione
Misino System commercializza videocorsi di formazione in ambito finanziario e in particolare di trading automatico;
L’Utente riconosce in capo a Misino System la proprietà esclusiva di tutti i contenuti, anche digitali, le informazioni, i documenti e i dati concernenti i prodotti e i servizi acquistati presso Misino System
L’acquisto dei prodotti e servizi da parte dell’Utente è destinato ad uso strettamente personale.
L’Utente si obbliga, pertanto, a mantenere la riservatezza e a non divulgare, diffondere o far utilizzare a terzi, in tutto o in parte, in qualsiasi forma e con qualsiasi modalità, informazioni, dati, dati di accesso quali username e password, contenuti, anche digitali, e conoscenze riservati.
6. Modalità di pagamento e prezzi
Il prezzo sarà quello indicato di volta in volta sul sito, ovvero nell’offerta individualmente trasmessa via e-mail all’utente.
Il pagamento dei prodotti acquistati sul sito potrà essere effettuato tramite: Stripe, Paypal, Bonifico bancario, ovvero Carta di credito.
7. Consegna
La consegna del prodotto avviene per via telematica.
Dopo che avra' effetuato il pagamento l'utente avra' accesso al percorso formativo con le credenziali immesse al momento dell ' ordine.
Il Corso sara' erogato in maniera frazionata e settimanalmente nell' arco di 15 giorni.
8. Recesso
In base alla Nuova Direttiva Europea 2011/83/Ue del Parlamento Europeo e del Consiglio Europeo del 25 Ottobre 2011 sui Diritti dei Consumatori Il diritto di recesso non può essere esercitato sui contenuti digitali (eBook,Dispense Pdf, Mp3 e Videocorsi in download)
Quindi:
- Se il corso non e' ancora cominciato, nessun video e' stato guardato , sara' possibile ottenere il rimborso di quanto pagato entro 14 giorni.
- Se il corso e' gia' cominciato non sara' possibile ottenere il rimborso in nessun caso.
9. Trattamento dei dati
I dati dell’acquirente sono trattati conformemente a quanto previsto dalla normativa in materia di protezione dei dati personali, come specificato nell’apposita sezione “Privacy Policy” contenente l’informativa ai sensi dell’art. 13 del Regolamento UE 679/2016 (GDPR), nonché sull’utilizzo dei cookie con il relativo consenso al trattamento laddove richiesto (Cookie Policy).
10. Clausola di salvaguardia
Nell’ipotesi in cui una delle clausole delle presenti Condizioni Generali di Vendita fosse nulla per qualsivoglia motivo ciò non comprometterà in nessun caso la validità e il rispetto delle altre disposizioni contenute nelle presenti Condizioni Generali di Vendita.

12. Legge applicabile, Foro competente e ODR (Online Dispute Resolution)
Il contratto concluso tramite il sito è regolato dalla legge italiana ed eventuali controversie inerenti all’applicazione, esecuzione e interpretazione delle presenti Condizioni Generali di Vendita dovranno essere risolte in via esclusiva dall’autorità giurisdizionale italiana.
Nel caso in cui l’utente rivesta la qualità di consumatore, per le suddette controversie è competente il Giudice del luogo di residenza o domicilio dell’utente consumatore.
In ogni caso, è fatto salvo il diritto del cliente consumatore, ove ne ricorrano i presupposti, di promuovere una risoluzione extragiudiziale delle controversie relative ai rapporti di consumo mediante ricorso alle procedure di cui alla Parte V, Titolo II-bis del D.Lgs. n. 206/2005 (Codice del Consumo).
È fatta salva l’applicazione agli utenti consumatori che non abbiano la residenza abituale in Italia delle disposizioni eventualmente più favorevoli e inderogabili, previste dalla legge del Paese in cui risiedono abitualmente.
Ai sensi e per gli effetti dell’art. 14 del Regolamento UE n. 524/2013, si informano i consumatori residenti negli Stati appartenenti all’Unione Europea che, per la risoluzione delle controversie relative ai contratti di acquisto di prodotti e servizi online offerti da questo sito, vi è la possibilità di ricorrere al procedimento di Online Dispute Resolution (ODR), previsto dalla Commissione Europea, e raggiungibile al seguente link: https://webgate.ec.europa.eu/odr.

General Terms and Conditions of Sale
1. General provisions
By navigating in this area, the user accesses the Misino System website. Navigation and the transmission of a purchase order on the Misino System website imply the acceptance of these General Conditions of Sale, as well as of the Data Protection Policies, contained in the appropriate "Privacy Policy" section of the website.
The user is required, before accessing the products and services provided by the site, to read these General Conditions of Sale, which are generally and unequivocally accepted at the time of purchase.
Misino System reserves the right to modify these General Conditions of Sale at any time.
The user is invited to download and print a copy of the purchase form and of these General Conditions of Sale.
2. Object
These General Conditions of Sale apply exclusively to the purchase of products and the supply of services marketed, via the website, to their Users, in accordance with the provisions of Part III, Title III, Chapter I, Consumer Code (Legislative Decree . n. 206/05) directly from:

Misino System is therefore not responsible for the sale of products and/or provision of services by third parties, possibly present on its site, through links, banners or other hypertext links.
Before forwarding orders and purchasing products and services from different subjects, it is therefore advisable to check their conditions of sale.
3. Conclusion of the contract
To conclude the contract, it will be necessary to fill in the purchase form following the instructions that will appear on the site.
The seller is not, in any case, responsible for any inadequacy of the graphic representations of the products, having the same purely illustrative function.
Before concluding the contract, the user will be asked to confirm that he has read the General Conditions of Sale, including the Information on the right of withdrawal and the processing of personal data, as well as to specifically approve, pursuant to articles 1341 and 1342 of the Civil Code, some clauses contained in these General Conditions of Sale.
The contract is concluded when the seller receives the purchase form, after verifying the correctness of the data contained therein.
The buyer will be obliged to pay the price from the moment the online order forwarding procedure is completed. This will be done by clicking on the "complete my order" button at the end of the wizard.
Once the contract is concluded, the seller takes charge of the order for its fulfillment and an order confirmation e-mail will be sent to the user.
4. Registered users
Registration on the site and the purchase of products is allowed to all subjects who, if natural persons, have reached the age of 18.
In completing the registration procedure, the user undertakes to follow the instructions on the site and to provide their personal data correctly and truthfully.
The user undertakes to promptly notify Misino System of any variation of his data, in any case exempting Misino System from any liability in the event of inaccuracy of the data provided. If the user communicates inaccurate or incomplete data, or even in the event that there is a dispute by the interested parties regarding the payments made, Misino System will have the right not to activate or suspend the service until the correct communication of all the data required.
On the occasion of the first request for activation of a profile by the user, Misino System will attribute a username and password to the same. The latter acknowledges that these identifiers constitute the validation system of the user's access to the Services and the only system suitable for identifying the user and that the acts performed through this access will be attributed to him and will have binding effect on him.
The user undertakes to maintain the secrecy of his access data and to keep them with due care and diligence and not to transfer them, even temporarily, to third parties.
In any case, the registered user undertakes to hold Misino System harmless and harmless from any claim, damage, compensation obligation and/or sanction deriving from, or in any case connected to, the violation by the user of the rules on registration on the site or on retention of registration credentials.
5. Marketed products, intellectual property and confidentiality and non-disclosure agreement
Misino System sells training video courses in the financial sector and in particular in automatic trading;
The User acknowledges that Misino System has the exclusive ownership of all contents, including digital ones, information, documents and data concerning the products and services purchased from Misino System
The purchase of products and services by the User is intended for strictly personal use.
The User therefore undertakes to maintain confidentiality and not to disclose, disseminate or have third parties use, in whole or in part, in any form and by any means, information, data, access data such as username and password, content , even digital, and confidential knowledge.
6. Payment methods and prices
The price will be that indicated from time to time on the site, or in the offer individually sent by e-mail to the user.
Payment for products purchased on the site can be made via: Stripe, Paypal, bank transfer, or credit card.
7. Delivery
The delivery of the product takes place electronically.
After making the payment, the user will have access to the training course with the credentials entered at the time of the order.
The course will be delivered fractionally and weekly over 15 days.
8. Withdrawal
According to the New European Directive 2011/83/EU of the European Parliament and the European Council of 25 October 2011 on Consumer Rights, the right of withdrawal cannot be exercised on digital contents (eBooks, PDF handouts, Mp3s and downloadable video courses)
So:
- If the course has not yet started, no videos have been watched, it will be possible to obtain a refund of the amount paid within 14 days.
- If the course has already started it will not be possible to obtain a refund under any circumstances.
9. Data Processing
The buyer's data is processed in compliance with the provisions of the legislation on the protection of personal data, as specified in the specific "Privacy Policy" section containing the information pursuant to art. 13 of EU Regulation 679/2016 (GDPR), as well as on the use of cookies with the relative consent to treatment where required (Cookie Policy).
10. Safeguard Clause
In the event that one of the clauses of these General Conditions of Sale is void for any reason, this will in no case compromise the validity and compliance with the other provisions contained in these General Conditions of Sale.

12. Applicable Law, Jurisdiction and ODR (Online Dispute Resolution)
The contract concluded through the site is governed by Italian law and any disputes relating to the application, execution and interpretation of these General Conditions of Sale must be resolved exclusively by the Italian jurisdictional authority.
In the event that the user acts as a consumer, the Judge of the place of residence or domicile of the consumer user is competent for the aforementioned disputes.
In any case, without prejudice to the right of the consumer customer, where the conditions are met, to promote an out-of-court settlement of disputes relating to consumer relations by resorting to the procedures referred to in Part V, Title II-bis of Legislative Decree no. 206/2005 (Consumer Code).
Without prejudice to the application to consumer users who do not have their habitual residence in Italy of any more favorable and mandatory provisions, provided for by the law of the country in which they habitually reside.
